BAT conclusions

A new important part of the BREFs (BAT reference documents) are the BAT conclusions. These are the conclusions about the Best Available Techniques. Here you will find, among other things, a description of the emission levels associated with the best available techniques and the monitoring that goes along with it. These BAT conclusions will be adopted by a committee of the country members (article 75). They will be translated in all languages of the EU member states.

According to article 14, paragraph 3 of the Industrial Emissions Directive, the BAT conclusions are the reference for the licence. In article 15, paragraph 3, the emission limit value in the licence cannot be higher than the BAT-associated emission levels (BAT-AELs) from the BAT conclusions. Derogations are only allowed under strict preconditions (article 15 paragraph 4).

Within a period of 4 years after publication of the BAT conclusions of the main activity of an IPPC installation by the European Commission, the licence conditions should be reconsidered and should be adapted on the new BAT conclusions. Moreover, the installation should meet the new licence conditions (article 21 paragraph 3 Industrial Emissions Directive).
